The promoter

1. This promotion (the Promotion) is run by District 94, ABN 91 610 804 585, of Melbourne, Victoria, Australia (the Promoter, we, us). Contact: hq@districtninetyfour.com.
2. By entering, you accept these terms. These terms apply alongside Kickstarter's own Terms of Use, which cover your pledge.

Who can enter

1. Entry is open only to residents of Australia who have a delivery address in Australia.
2. Entrants under 18 must have permission from a parent or legal guardian to enter. If an entrant under 18 wins, the prize will be awarded to their parent or guardian on their behalf.
3. The following people cannot enter: employees, directors, contractors and agents of the Promoter, anyone involved in running this Promotion, and their immediate families (spouse or partner, parents, children and siblings) and people who live with them.

How to enter

1. To enter, you must back the District 94 Unit 01 Equipment Drop campaign on Kickstarter during the Promotion Period with one of these reward tiers, each of which includes at least one Unit 01 Tee:
   • Early Bird Unit 01 Tee
   • Standard Issue Unit 01 Tee
   • Two-Unit Patrol Pack
   • Full District Squad Bundle
2. The following do not count as an entry: the Resident Entry Pass (sticker) tier, a pledge without a reward ("pledge without a reward" or a donation), a pledge for add-ons only, and any pledge made after the campaign ends (including late pledges).
3. Entry is automatic. You do not need to do anything other than back an eligible tier.
4. One entry per backer. Each Kickstarter account gets one entry, no matter how much you pledge or how many tees your tier includes. Each person may only enter once, even if they use more than one Kickstarter account.
5. Your entry is only valid if your pledge is successfully collected by Kickstarter when the campaign ends, and is not later cancelled, refunded, charged back or dropped. If your payment fails and is not fixed within the period Kickstarter allows, your entry is void.
6. If the campaign does not reach its funding goal, no pledges are collected and this Promotion will be cancelled. No prize will be awarded.

Promotion period

1. The Promotion opens when the Kickstarter campaign goes live and closes when the campaign ends, at the date and time shown on the Kickstarter campaign page (the Promotion Period).
2. Kickstarter's record of when your pledge was made is final.

The prize

1. There is one prize: one authentic full-size Wilson official NBA authentic basketball hand-signed by Dyson Daniels, supplied with a Certificate of Authenticity from Beckett Authentication Services. The prize is valued at less than AUD $3,000 including GST, and the total prize pool is less than AUD $3,000.
2. The ball was bought independently by the Promoter on the collectibles market. It is not supplied by, sponsored by or endorsed by Dyson Daniels or any team or league.
3. The prize is the specific ball shown on our campaign page and social channels. The signature's position and any inscription may differ from other photos of similar balls.
4. The prize cannot be exchanged, transferred or redeemed for cash. If the prize is lost, damaged or becomes unavailable for reasons outside our control, we may replace it with an authentic signed item of equal or greater value.
5. The prize does not include a meeting with, or any appearance by, Dyson Daniels.

The draw

1. The winner will be drawn at random from all valid entries using a random number generator, at the Promoter's premises in Melbourne, Victoria, within 7 days after the Promotion Period closes and after Kickstarter has finished collecting pledges.
2. At the same draw we will also draw 3 reserve entries, in order, in case the prize needs to be redrawn.
3. The draw will be recorded on video, and the recording will be kept for at least 12 months.
4. This is a game of chance. Skill plays no part in deciding the winner.

Winner notification and claiming

1. We will contact the winner by Kickstarter message and by the email address linked to their Kickstarter account within 2 business days of the draw.
2. To claim the prize, the winner must reply within 14 days of our first message, confirm that they are eligible, and give us their full name and Australian delivery address. We may ask for proof of identity, age or residential address.
3. If the winner does not claim the prize within 14 days, is not eligible, or has broken these terms, they lose the prize and we will offer it to the next reserve entry in order, who will also have 14 days to claim it.
4. We will announce the winner (first name, last initial and state only) in a Kickstarter backer update and on our social channels within 7 days of the prize being claimed. Where the law requires it, we will also publish the winner's details.

Delivery

1. We will post the prize to the winner's Australian address at no cost to them, with tracking and insurance, either with their Unit 01 rewards or earlier.
2. Once the prize is delivered to the address given by the winner, it becomes the winner's responsibility. We are not responsible for a prize that cannot be delivered because the address given was wrong.

Not affiliated

1. This Promotion is run only by the Promoter. It is not sponsored, endorsed, run by, or connected to Dyson Daniels, the Atlanta Hawks, the NBA, the NBL, Basketball Australia, or any other team, league or player.
2. This Promotion is not sponsored, run or endorsed by Kickstarter. Kickstarter is not responsible for the Promotion or the prize. Questions about the Promotion go to us, not Kickstarter.
3. Names of players, teams and leagues are used only to describe the prize accurately.

Your information

1. To run the Promotion, we use the backer information Kickstarter shares with us (name, email, reward tier, pledge status and delivery address). We use it only to run the draw, contact and verify the winner, deliver the prize, and meet our legal obligations.
2. We will not sell your information or use it for marketing because of this Promotion. You can ask to see or correct the information we hold about you by emailing hq@districtninetyfour.com.
3. We will only use the winner's photo or a photo of them with the prize if they agree. Saying no will not affect their prize.

Fair play

1. We may disqualify any entry, and anyone who enters, if we reasonably believe they have broken these terms, given false information, used several accounts to try to get more entries, or interfered with the Promotion.
2. If something outside our reasonable control (such as fraud, a technical failure, or an issue with Kickstarter) affects how the Promotion runs, we may change, pause or cancel it, subject to any directions from a government authority.
3. Our decisions about the Promotion are final. We will not discuss them, except as required by law.

Liability and tax

1. Nothing in these terms limits any rights you have under the Australian Consumer Law or any other law that cannot be excluded.
2. As far as the law allows, we are not liable for any loss or damage (including indirect loss) arising from the Promotion or the prize, except where it is caused by our negligence or wrongdoing.
3. The winner should get their own advice on any tax that may apply to the prize. The Promoter is not responsible for the winner's tax.

General

1. These terms are governed by the laws of Victoria, Australia.
2. If any part of these terms cannot be enforced, the rest still applies.
3. We may update these terms to correct mistakes or to comply with the law or Kickstarter's rules. Any changes will be posted on this page and will not reduce entrants' chances of winning.
